Finally It Took 69 Years and Modi Government To Fight For Muslims Women Against Tripal Talaq

Human rights is a important issue not just in India but around the world. While the united nations have been looking at how to address the injustice done to women in the name of unjustified divorce Modi lead BJP government has worked efficiently to abolish Triple talaq in India. The issue is now placed before the highest court of Law. Triple talaq practice as per sharia has been a nightmare for Muslim women in India. About 170 million Muslims in India are Sunnis and are governed by Muslim Personal Law for family matters and disputes. This law board allows men to divorce women uttering the word “Talaq” thrice

Tripal Talaq is banned in prominent hardline Muslim countries like Turkey, Cyprus, Pakistan and Bangladesh, however a secular nation like India continues to practice this which is against the human rights. Noorjehan Safia Niaz, co-founder of Bhartiya Muslim Mahila Andolan, or the Indian Muslim Women’s Movement says Muslim women have been divorced by speed post, by sending out letters. Some have just simply said “talaq” three times and the divorce has happened and many other still don’t know why they were divorced. Not many media and political parties dare to talk about these unconstitutional practice in Muslim community since the community form their core vote bank so the law makers turn blind eyes. When a Hindu majority country can out throw Hindu personal boards then why would the same country let women from the Muslim community be governed by Muslim personal board which is doing no good to establish a secure life for Muslim womens.
Though most of the women leaders avoided direct comments on the Centre’s affidavit or sought to dissect it, they were strongly critical of the prevalent practice of dissolving marriage through ‘triple talaq’. Manipur Governor Najma Heptulla, who was the Minority Affairs Minister in the Narendra Modi cabinet before being appointed to the gubernatorial post, refrained from giving her opinion on the Centre’s stand, but, on a personal level, said an “un-Islamic” interpretation was being given to the practice of ‘triple talaq’. Few months ago women’s movement collected more than 50,000 signatures, calling for a nationwide ban on instant divorces. The plead to abolish Tripal Talaq by Muslim women fell on deaf ears all this while since political parties ruling this nation from last 60+ years were only concerned about vote bank however Modi is a lot different. He stands for the right of people and he believes in one nation one law. There are a lot of instances where Muslim women have personally written to Indian PM Narendra Modi to abolish Tripal Talaq. As the fight to abolish Tripal Talaq intensifies The Allahabad High Court today termed the Islamic practice of divorcing a woman by uttering the word “talaq” thrice as unconstitutional. This comes as a huge set back to the under Muslim Personal Law board and certain political parties which have been supporting such unethical practice.
The High Court further observed that the triple talaq practice sanctioned under Muslim Personal Law that governs marriage, property and divorce violates the rights of Muslim women.

Court said “Triple talaq is unconstitutional, it violates the rights of Muslim women,” ruled the High Court, adding that no personal law board is above the Constitution.”

Several women have filed a petition before the Supreme Court seeking the quashing of the triple talaq practice. The Central Government has also told the top court that it is against gender injustice and for equality between men and women under the Constitution.

It’s just a matter of time before Triple talaq would be abolished and we need the applauded the effort of government of India for helping Muslim women fight for justice and social equality which they have been deprived from centuries. BJP government have done a extraordinary job in addressing the issue of Triple talaq. We only hope the “One Nation, One Law” Is implement and justice is prevailed for every Muslim women who have been the victims of Triple talaq
