Truth About Lalu Prasad Yadav and his son’s allegation that RSS (and BJP) killed Gandhi

                The former Chief Minister of Bihar and former Railway Minister Lalu Prasad Yadav (who is a very casteist man) had alleged in April 2004 before the 2004 Lok Sabha polls in a TV debate with Sharad Yadav on Star News that Sharad Yadav has allied with people who killed Mahatma Gandhi, implying that BJP and RSS are killers of Mahatma Gandhi. At that time, a case should have been filed against Lalu.

                 In this regard, some cite the statement made by a brother of Nathuram Godse to The Times of India in 1994 that he and Nathuram Godse had not left RSS and that he dissociated himself from RSS in court only to save the RSS. This statement has absolutely no legal value, since what matters is what was said to the court by the killer, not what was claimed to a newspaper by a relative years after that incident. Even if, for arguments sake, Nathuram Godse had not left RSS at the time of Gandhiji’s killing in 1948, the RSS as an organization cannot be held responsible for the deeds of one member. No court found the RSS involved in any way, and no one apart from the Godses and Narayan Apte. If an entire party or organization were to be blamed for proven acts of one member or few members, then following facts should be noted:

2- Congress members have been found guilty of involvement in acts like bomb blasts (eg. 1993 Surat bomb blasts), communal riots etc

                                                                                                                                                     The same charge has now been repeated by Lalu Yadav in July 2017 after the JD(U) and RJD broke away from their alliance. Lalu has said: “Narendra Modi ne achhe din, naukri ka jhansa diya, dhong racha. It is regrettable there is no Gandhiji among us to unite this country.                                                                                                                                                    Lalu Yadav in the past tried to defend the fanatic Islamists who roasted 59 Ram sewaks in Godhra, appointed the Banerjee Committee and said in public rallies in Bihar before the Feb-March 2005 Bihar election: “BJP-RSS people killed 59 people in Godhra, said ‘Muslims killed them’. Now the truth is out.” The Banerjee Committee said that Godhra was an accident, not that BJP-RSS men killed the Ram sewaks. If it was an accident, then how could RSS-BJP people have killed them? At that time, a defamation case should have been filed against Lalu by BJP and RSS and court orders obtained (or tried to be obtained, at least) to restrain him from making this allegation in Bihar. He also repeated the lie and parroted it in Bihar before the Oct-Nov 2015 election that “RSS chief Mohan Bhagwat has demanded reservations should end” when the RSS chief had not said anything of the sort in his interview to Organiser. At that time also, it had been urged that a court order should be tried to be obtained to restrain Lalu from making this charge before the Bihar electorate and ordering the media to report for twice the duration of time that they misreported, that the RSS supports reservation and Mohan Bhagwat did not demand end to reservations, rather openly supported them in that interview to Organiser, and even earlier eg. in September 2014. http://www.livemint.com/Politics/5HiGzVhWg11OVQ0VOLyRXN/Reservation-is-needed-till-there-is-inequality-in-society-R.html
                                                                                                                                                         This man Lalu needs to be brought to justice for his open casteism, and support to fanatic Muslims who roasted Ram sewaks to coal in Godhra. All past chances were wasted. It should not be wasted now. Lalu Yadav’s son Tejashwi also said that BJP is a party which assassinated Mahatma Gandhi. BJP was founded in 1980, while its predecessor Jana Sangh was founded in 1951 while Gandhiji was assassinated in 1948. Tejashwi, unleashing a tirade of fiery slavos on Kumar, said that the latter has stitched an alliance with a party who conspired the assassination of Mahatma Gandhi. “Do you not feel ashamed sitting next to Sushil Kumar Modi? You take out Champaran yatra and then stitch an alliance with a party which assassinated Mahatma Gandhi,” said Tejashwi.
                                                                                                                                                         The BJP has a full-proof case against Tejashwi on this charge, since it was founded in 1980 while its earlier avatar Jana Sangh was also founded much after Gandhiji’s killing. This golden chance of filing defamation suits against Lalu and his son should not be wasted now. BJP as well as RSS need to file defamation suits. Arun Jaitley’s defamation suit against Kejriwal and other AAP leaders in Dec 2015 showed how they can all be brought on straight line- they all stopped their allegations immediately and turned into tame cats. Jaitley rightly filed another case of 10 crores after Advocate Jethmalani used a derogatory word in the defamation suit arguments in court.
  
      As a matter of fact, big fish Sonia Gandhi too could have been sued for damages worth crores for her statement on 21 October 2000 in Uttar Pradesh, saying that Sangh Parivar killed Mahatma Gandhi.  The link for it is :
                                                                                                                                                But that chance was wasted, and now she cant be prosecuted since under the law of limitation a defamation suit has to be filed within 1 year of the charge being made.
                                                                                                                                               It is time to sue Lalu and his son for a HUGE amount. Justice Kapoor Commission appointed to probe this also said RSS could not be held responsible for Gandhi ji’s killing. All we need to sue this man is 1 member of RSS or 1 member BJP giving consent to prosecute.

The Statesman, English daily from New Delhi and Kolkata, has tendered an unconditional apology to the Rashtriya Swayamsevak Sangh (RSS) for its editorial-Not illegal but stupid-published on 29-05-2000, in which it had alleged that the ‘RSS was an organisation which killed Gandhi’. It may be recalled that on the publication of the above mentioned editorial, Shri Darshan Lal Jain, Prant Sanghchalak of Haryana, filed a complaint under section 499/500 Cr.P.C. on September 26, 2000, through Shri Pradeep Garg, advocate, against the newspaper for its defamatory remarks, in the court of Shri Atul Maria, Judicial Magistrate, Class-I, Jagadhari. The accused namely Shri C.R. Irani, editor in chief, The Statesman, Kolkata, Sudhir Kumar, Printer and Publisher, Kolkata, Ravindra Kumar, Managing Editor, Kolkata, Saubhik Chakravarty, Resident Editor, New Delhi and Shri Saby Thomas, printer and publisher, New Delhi were accorded to be summoned by the Magistrate on December 16, 2002. Shri C.R. Irani, Shri Ravindra Kumar and Shri Saubhik Chakraborty appeared before the court in person on March 28, 2003 and were bailed out on furnishing the surety of Rs 7000 each. The other two accused were again required to appear before the court on September 27, 2003. On their failure to appear, bailable warrants were issued against Sudhir Kumar. Shri Suman Kapoor, advocate, High Court Delhi, counsel for the accused, made an offer of compromise on September 27, 2003 to apologise unconditionally for the defamatory comments. In an application filed for the admission of the compromise, The Statesman stated that it had gone through the defamatory write-up. They also admitted that the allegations made by the accused against RSS are absolutely wrong and baseless and all the accused tender unconditional apology for the same. “In fact, the accused had no intention to insult or defame this esteemed and patriotic organisation i.e. the RSS and this publication was flashed in the column of our paper due to some misunderstanding.” On publication of the unconditional apology on the front page of The Statesman of Delhi and Kolkata, Siliguri, Bhubneshwar on 11 October 2003, the case was withdrawn on 14 October 2003 by the complainant. 


2- A G Noorani On 15 January 2000, a daily, The Statesman, carried a story about the RSS by A G Noorani, which depicted the RSS as the killer of Gandhi. Subsequently the Delhi unit of the RSS filed a criminal case of defamation against author of the article A G Noorani along with the cartoonist and the Managing Director of the publishing house. When two of the accused did not respond to the Court summons, non-bailable warrants were issued in their name by the Court. On 25 February 2002, Noorani wrote an unconditional apology to the court in which he regretted writing the defamatory article against the RSS. On 3 March 2002, ‘The Statesman’ also published an apology regretting the publication of the said article

Full text of The Statesman’s Front paged apology on 11 Oct 2003: “An apology: In an editorial entitled “Double Standard – Not Illegal but Stupid” (The Statesman, 29-30 May 2000), we had described the Rashtriya Swayamsewak Sangh as “the organisation that killed Gandhi”. This was incorrect, and unsupported by both facts and the record. We express regrets for the publication and apologise unconditionally for the anguish and mental torture caused to members of the organisation. This apology follows in the case “Darshan Lal Jain Vs CR Irani and others” in the court of Mr Atul Marya, Ld, Judicial Magistrate 1st class, Jagadhri (Haryana) in which the complainant was being represented by Mr Pardeep Garg, Advocate.”
